1.1. This Privacy Policy covers use of the Website (both web and mobile versions) of Starke Robotik Sdn Bhd and its affiliates (collectively referred to as "we" or "us" or “our” or “ours) through the use of our products, features, information, software, functions and related services (collectively referred to as “Services”). This Privacy Policy explains how we collect, use, share, process and disclose the personal information that you provide to us in accordance with the Personal Data Protection Act 2010 (“PDPA”).

1.2.  If you are accessing or using the Services on behalf of a business or entity, then: (a) “you” and “your” includes you and that business or entity; (b) you represent and warrant that you are an authorized representative of the business or entity with the authority to bind the entity to this policy and that you agree to this policy on the entity’s behalf; and (c) your business or entity is legally and financially responsible for your access to and use of the Services as well as for the use of your account by others affiliated with your entity, including any employees, agents or contractors.

1.3.  In the course of you using our websites and services operated by us, we will be collecting, using, disclosing, storing and/or processing data, including your personal data. We collect the personal data described in 2.0 below in accordance with applicable local laws and, if required, upon obtaining your consent. It is important that you read this Privacy Policy so that you are fully aware of how and why we are using your personal data.

1.4.  We may amend or update this Privacy Policy from time to time by posting a revised version on the Website. While we endeavour to send a notice every time the policy is amended and/or updated, you will be deemed to have acknowledged and agreed to the amended/ updated Privacy Policy if you continue to use the Website, or our services after the changes have taken effect. You are reminded to check this Website from time to time for updates to this Privacy Policy.

1.5.  We are committed to safeguarding your personal data, protecting your privacy and providing you with a secure environment when you browse the Website, use or subscribe to our Services. When you access our Website, Services or when you register at our Website, you accept our Privacy Policy and Terms of service whereby you consent to our collection, storage, use and disclosure of your personal information as described in this policy.

 

2.0.  What Information We Collect

2.1. Personal Data You Provide

Personal data may be collected through the use of our Website and Services. The personal data that we collect are:

  • Your profile information, such as your name, date of birth, gender, address, occupation, username, password, email address, telephone number, your interests, company name, company address, and your photograph.
  • Account and transaction information, such as payment method, payment card details, bank account information, bank statements, billing address, contact information, and items you purchased.
  • Usage Data such as information regarding your use of and how you engage with the Website and Services, browsing and search history, the content you like, orders and other products and services related to you.

2.2    Technical Data 

  • Device Information, such as hardware model, serial number, IP addresses, network type, operating system, device IDs, file and app names and versions.
  • Location Information. We may collect information about your approximate location, including location information based on your device IP address.  
  • We may use cookies, web beacons and other similar technologies (collectively, “Cookies”) in connection with your use of the Website and Services. Cookies are small text files placed in the memory of your browser or device when you visit a website or view a message. They allow us to recognise a particular device or browser. Web beacons are small graphic images that may be included on our Services and the Website.   • Improve and develop our Platform and conduct product development to enhance your customer experience;

We may also notify, invite and manage your participation in our surveys, events or activities.
  • If you do not wish to receive any promotional news please click the “unsubscribe” link in the relevant email or message and you will be excluded from our newsletters and contacts.

 

4.0.  How We Share Your Information

4.1. In the course of conducting our business, we will/may need to use, process, disclose and/or transfer your personal data to our third party service providers, agents and/or our affiliates or related corporations, and/or other third parties, which may be located in Malaysia or outside of Malaysia, for one or more of the above-stated purposes. Such third party service providers, agents and/or affiliates or related corporations would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes. These third parties and affiliates, include but are not limited to:

  • Other members, subsidiaries, or affiliates of our corporate group, including to provide, improve and optimise the Website, to prevent illegal use and to support users;
  • Service providers in areas such as payment services, advertising and marketing, data analytics, market or consumer research, survey, social media, customer service, installation services, information technology and website hosting;

5.0. Withdrawal of Consent to Continued Use, Disclosure, Storing and/or Processing of Personal Data

You may withdraw your consent for the collection, use and/or disclosure and/or request deletion of your personal data by contacting us using the contact details below, subject to the conditions and/or limitations imposed by applicable laws or regulations. We will process such requests in accordance with this Privacy Policy and our obligations under the Privacy Laws and other applicable laws.

5.2. However, by choosing to withdraw your consent to our use of it and for the purposes and the manner as stated above, could mean that we are unable to perform the actions necessary to achieve the purposes of processing described in Section 3.0 (Use of Personal Data) or that you are unable to make use of the Services. We will not be liable in the event that we do not continue to provide the Services to, or perform our contract with you. Our legal rights and remedies are expressly reserved in such an event.

5.3. You may unsubscribe from receiving marketing information at any time by using the unsubscribe function within the electronic marketing material. 

 

6.0. Updating and Correcting Your Personal Data

6.1. You may inquire about your personal data which we have collected, or enquire about the processing of your personal data via the personal account information setting on our Platform or by contacting us using the contact details in Section 11 below.

6.2. You are responsible for informing us of changes to your personal data, or in the event you believe that the personal data we have about you is inaccurate, incomplete, misleading or out of date.

6.3. You can access, edit and/or update your personal data anytime by signing into your account on the Website.

6.4. You may also request to edit, correct and/or delete your personal data. In order to facilitate processing of your request, it may be necessary for us to request further information relating to your request. Where permissible under law, we may refuse such correction requests if deemed vexatious or unreasonable.

6.5. Where permitted by applicable data protection laws, we reserve the right to charge a reasonable administrative fee for retrieving your personal data records. If so, we will inform you of the fee before processing your request.

6.6.  We may also share the updates to your personal data with third parties and our affiliates with whom we have shared your personal data if your personal data is still necessary for the above-stated purposes.

 

7.0.  Security of Your Personal Data

7.1.  We will take reasonable measures to ensure that your Personal Data is protected which includes preventing Personal Data from getting lost, used or accessed in an unauthorised manner. We strictly limit access to your Personal Data by our employees on a need to know basis. Those processing your Personal Data can only do so in an authorised manner and are required to treat your information with confidentiality.

7.2. Nevertheless, please understand that the transmission of information via the Internet or any method of electronic storage is not completely secure. While security cannot be guaranteed, we will do our best to protect the security of your information and are constantly reviewing and enhancing our information security measures to protect your Personal Data.

You are also advised to exercise caution with respect to the sharing of your personal data and your authentication / security details (such as passwords, credit card details, transaction details) outside of our Services.  We will not be responsible for any unauthorised use of our Services, users who act on your behalf or any unauthorised users. It is your responsibility to make your own informed decisions about the use of our Services and take necessary steps to prevent any misuse of our Services.  

 

8.0.  Retention of Personal Data

We will retain your personal data for as long as necessary to comply with operational, contractual and legal obligations or business purposes outlined in this Privacy Policy. We will cease to retain your personal data by securely disposing of the same, or remove the means by which the data can be associated with you through anonymisation, as soon as it is reasonable to assume that such retention no longer serves the purposes for which the personal data was collected, and is no longer necessary for any legal or business purpose.

 

9.0.  Personal Data of Minors

9.1. Our Services are not intended for minors (which is to be determined based on the applicable law). We do not knowingly collect any personal data relating to minors.

9.2. You hereby confirm and warrant that you are above the age of minority and you are capable of understanding and accepting the terms of this Privacy Policy.

9.3. As a parent or legal guardian, please do not allow minors under your care to submit personal data to us. In the event that such personal data of a minor is disclosed to us, you hereby consent to the processing of the minor’s personal data and accept and agree to be bound by this Privacy Policy and take responsibility for his or her actions.

10.1. The Website may contain links to other websites operated by other parties, such as our business affiliates, partner networks and vendors. Please note that even if the third party is affiliated with us, we have no control over these third party websites, each of which may have their own separate privacy and data collection practices independent of us. We therefore have no responsibility or liability for the content, security arrangements and activities of these linked sites. These linked sites are only for your convenience and you therefore access them at your own risk. Nonetheless, we seek to protect the integrity of our Website and the links placed upon each of them and therefore welcome any feedback about these linked sites.
